
Warranty, Service Terms & Product Liability Waiver

Company: Coastal Marine & Retrofit Services LLC (“Coastal Marine,” “we,” “our,” or “us”)
1. Workmanship Warranty
Coastal Marine & Retrofit Services LLC warrants all workmanship performed by our technicians for a period of 30 days from the date of service completion. This warranty covers defects in labor and installation only.
If an issue arises due to faulty workmanship within this period, Coastal Marine will, at its discretion, correct the problem at no additional cost to the customer. Warranty labor is performed during normal business hours and scheduled based on service availability.
2. Manufacturer Warranties
All parts, components, and equipment installed by Coastal Marine are covered solely by their respective manufacturer warranties.

We assist customers in submitting manufacturer claims.

Labor to remove or reinstall manufacturer-warranted parts is not covered and will be billed at a reduced rate of $125/hour.

Customers are responsible for retaining serial numbers, installation documents, and proof of purchase when required by the manufacturer.
3. Warranty Exclusions
This warranty does not apply to:

Damage from misuse, neglect, improper operation, or abuse.

Failures caused by corrosion, electrolysis, grounding issues, lightning, or acts of nature.

Hidden or pre-existing conditions, including prior improper wiring or fuel system installations.

Customer-supplied parts, non-marine-rated components, or cosmetic issues.

Normal wear and tear or consumables (filters, gaskets, lubricants, bulbs, etc.).

Repairs or modifications made by unauthorized personnel.
4. Diagnostic Fees & Estimates
Diagnostic labor and inspection time are billable even if the customer declines repairs.
All estimates are provided in good faith but may change after teardown, testing, or discovery of concealed damage.
5. Customer Responsibilities
Customers are responsible for:

Providing accurate information regarding vessel systems and issues.

Ensuring safe dock access, power, and workspace.

Maintaining sufficient battery charge and fuel for testing or sea trials.
Coastal Marine is not liable for delays, damages, or additional costs resulting from incomplete or inaccurate information provided by the customer.
6. Environmental & Access Limitations
Service schedules may be affected by weather, tides, marina access, or unsafe conditions.
Coastal Marine reserves the right to reschedule or suspend work if conditions jeopardize safety, quality, or compliance with ABYC or Coast Guard standards.
7. Vessel Storage, Dockage & Sea Trials
Coastal Marine assumes no liability for loss, theft, or damage to vessels during storage, dockage, or testing unless directly caused by proven negligence of our personnel. All vessels must remain fully insured by their owners.
8. Electrical & Fuel System Disclaimer
Customers acknowledge that many marine electrical and fuel systems may contain latent or hidden defects. Coastal Marine is not responsible for consequential failures or damages that occur after service completion due to corrosion, degraded wiring, or previously improper installations.
9. Parts Ownership
All replaced components become property of Coastal Marine unless the customer requests return in writing before work begins.
10. Payment, Late Fees & Chargebacks

Payment is due upon completion unless otherwise agreed in writing.

Balances unpaid beyond 15 days accrue a 2% monthly finance charge.

Customers agree to pay all reasonable collection and legal costs.

Credit card chargebacks related to warranty or disputed work are expressly prohibited.
11. Photography & Media Use
Customer grants Coastal Marine permission to photograph or record non-identifiable images of vessels and completed work for documentation, training, or marketing, unless declined in writing.
12. Force Majeure
Coastal Marine shall not be liable for any delay or failure to perform due to causes beyond its reasonable control, including but not limited to severe weather, acts of God, material shortages, or labor strikes.
13. Limitation of Liability
Coastal Marine’s liability under this agreement is limited solely to the repair or replacement of defective workmanship.
We are not liable for indirect, incidental, or consequential damages, including loss of time, use, or income.
14. Product Liability Waiver
The customer acknowledges and agrees that Coastal Marine & Retrofit Services LLC is not the manufacturer or designer of any parts, products, or equipment installed or serviced.
Accordingly:

Coastal Marine assumes no product liability for failure, malfunction, or defect in any third-party part or product.

Responsibility for product safety, performance, and compliance rests solely with the manufacturer.

Customer agrees to hold Coastal Marine harmless from any and all claims, damages, or losses arising from product failure, design defects, or manufacturing errors.

For customer-supplied parts, the customer assumes full responsibility for compatibility, warranty coverage, and performance.
This waiver applies to all products, components, and materials installed, serviced, or supplied in connection with Coastal Marine’s work.
15. Warranty Claim Procedure
To initiate a warranty claim:

Notify Coastal Marine at info@coastalmarineservices.com within the 90-day workmanship warranty period.

Provide your name, invoice number, and a description of the issue.

Allow Coastal Marine reasonable access to inspect the vessel and verify the claim.
Valid claims will be scheduled for repair according to availability.
16. Governing Law & Arbitration
All disputes shall be governed by the laws of the State of Florida.
Any disputes arising under this agreement shall be resolved through binding arbitration in Seminole County, Florida, in accordance with the rules of the American Arbitration Association.
Customers agree to bear arbitration costs unless otherwise prohibited by law.
17. Entire Agreement
These Terms and Warranty constitute the entire agreement between the customer and Coastal Marine & Retrofit Services LLC.
No oral statements or prior agreements shall alter these terms unless in writing and signed by both parties.
18. Modifications
Coastal Marine reserves the right to amend this document at any time. Updates will be posted on our website and take effect upon publication.
19. Payment Assumes Acceptance
By submitting payment for services rendered, approving an estimate, or allowing work to commence, the customer acknowledges full understanding and acceptance of all terms, conditions, and warranties contained herein.
Payment constitutes a binding agreement between the customer and Coastal Marine & Retrofit Services LLC.
